What Is Provisional Credit on Direct Express? (How It Works)

If you disputed an unauthorized charge on your Direct Express card and you’re waiting to get your money back — or you noticed a credit appear on your account that you didn’t recognize — this guide explains what provisional credit is, when Direct Express is required to issue it, and what you need to do.

What is provisional credit?

Provisional credit is a temporary refund that Direct Express places on your account while investigating a transaction you disputed. It gives you access to the disputed funds during the investigation so you are not left without money while they work through the case.

The word “provisional” means temporary — it is not a permanent resolution. If the investigation finds in your favor, the credit becomes permanent. If Direct Express determines the original charge was legitimate, the provisional credit is reversed and the funds are taken back from your account.

When is Direct Express required to give provisional credit?

Provisional credit for debit card transactions is governed by Regulation E — a federal rule that protects consumers who use electronic payments including debit cards, ATMs, and direct deposits.

Under Regulation E, if Direct Express cannot complete its investigation within 10 business days of receiving your dispute, it must provisionally credit your account for the disputed amount while the investigation continues — which can take up to 45 days total.

How provisional credit works on Direct Express — step by step

  1. You report the dispute. Call the number on the back of your card and report the unauthorized or incorrect charge. Note the date you called and the case number.
  2. Direct Express opens an investigation. They send you a fraud questionnaire (usually within 3–5 business days after you call). Fill it out and return it promptly.
  3. Provisional credit is issued by day 10 — if the investigation cannot be completed by then and you have submitted the required paperwork. The credit appears in your available balance.
  4. Investigation continues — Direct Express has up to 45 days from your report to complete the investigation.
  5. Investigation concludes:
    • If the charge was unauthorized or an error: the provisional credit becomes permanent. You keep the money.
    • If Direct Express determines no error occurred: the provisional credit is reversed. The funds are taken back from your account. You receive written notice at least 5 days before the reversal.

What happens if you spend provisional credit that gets reversed?

This is a critical point. Provisional credit is available to spend while in your account — but if the investigation goes against you and the credit is reversed, your account will go negative for that amount, which will be deducted from your next benefit deposit.

Caution: If there is any chance the investigation may not go in your favor, avoid spending the provisional credit before the case is resolved. If the credit is reversed after you have spent it, your next deposit will be reduced to cover the negative balance.

How to make sure you get provisional credit

  • Report the dispute as soon as possible. The 10-business-day clock for provisional credit starts when you first report the error — not when you submit paperwork. Call immediately.
  • Submit the fraud questionnaire right away. When Direct Express sends you the paperwork, return it before the 10-business-day deadline. Failure to return it can allow them to withhold provisional credit.
  • Keep records of everything. Note the date and time you called, the case number, and the representative’s name. Keep copies of any documents you submit.
  • Report promptly after noticing the charge. You have 90 days from when you noticed the unauthorized transaction to report it to Direct Express (compared to the standard 60 days under Regulation E — Direct Express gives extra time).

  • File a complaint with the CFPB (Consumer Financial Protection Bureau) at consumerfinance.gov/complaint — the CFPB oversees Regulation E compliance
  • Contact the Treasury OIG — the U.S. Treasury Office of Inspector General oversees the Direct Express program
